CBD Legality Status in Idaho
The USDA was expected to submit a plan in the Fall or 2019 (right now) for state adoption of the 2018 Farm Bill signed by President Trump. On May 28, 2018, the USDA issued a non-binding opinion letter in which the agency explained, in part, that states and Native American tribes may not prohibit the interstate transportation or shipping of hemp or hemp products lawfully produced under the 2014 Farm Bill. Nothing beyond the opinion letter has been produced by USDA at this writing.
The author of the 2019 Idaho State House of Representatives bill HB 122 will introduce it again, somewhat modified, to create a temporary rule legalizing Hemp Oil in Idaho in the January, 2020 legislative session. The DEA moved CBD with no more than 0.1% THC from Schedule I and placed it on Schedule V in September of 2018. Schedule V applies to drugs with demonstrated medical value and deemed unlikely to cause harm, abuse, or addiction. The Federal Register/Vol. 83, No. 189/Friday, September 28, 2018/Rules and Regulations states: “SUMMARY: With the issuance of this final order, the Acting Administrator of the Drug Enforcement Administration places certain drug products that have been approved by the Food and Drug Administration (FDA) and which contain cannabidiol (CBD) in schedule V of the Controlled Substances Act (CSA). Specifically, this order places FDA-approved drugs that contain CBD derived from cannabis and no more than 0.1 percent tetrahydrocannabinols in schedule V. This action is required to satisfy the responsibility of the Acting Administrator under the CSA to place a drug in the schedule he deems most appropriate to carry out United States obligations under the Single Convention on Narcotic Drugs, 1961. Also consistent therewith, DEA is adding such drugs to the list of substances that may only be imported or exported pursuant to a permit.”

This bill also makes hemp producers eligible for the federal crop insurance program and certain USDA research grants. This bill is already Federal Law and only Idaho and a few states are fighting your rights to higher quality relief. With the passing of future legislation more tax dollars can go to educational programs and research so one day opioids won’t even be an option for our youth to become addicted too.
